Terms of Service & Repair Agreement

Important information about repairs, remote support, purchases, data, warranties and customer equipment.

Effective August 27, 2026

These Terms govern the use of ComputerXpress.us and products and services provided by ComputerXpress (“we,” “our,” or “us”). By purchasing a product, submitting equipment, approving an estimate or authorizing service, you agree to these Terms and the applicable work order, estimate or separate agreement.

1. Authority

You confirm that you are at least 18 or have appropriate consent; own the submitted equipment or have the owner’s permission; may authorize access and service; and have provided accurate information. We may refuse unsafe, unlawful or impractical work.

2. Estimates and Authorization

Estimates are based on available information and may change if additional problems, parts or labor are discovered. We will request authorization before exceeding an approved amount unless you approved a written spending limit. Authorization may be documented by signature, email, text, online approval, recorded telephone authorization where permitted or another documented method.

Disclosed diagnostic fees may apply when repair is declined, equipment cannot be repaired, a problem cannot be reproduced, parts are unavailable or data cannot be recovered. Completion dates are estimates and are not guaranteed.

3. Customer Responsibilities

You agree to disclose known damage and prior work; remove unnecessary accessories; maintain a current backup whenever possible; provide reasonably required passwords, recovery keys or licenses; identify unusually sensitive or regulated data; keep contact information current; and retrieve equipment promptly. We are not responsible for accessories not documented at intake.

4. Equipment Condition

Testing or opening equipment may reveal or worsen preexisting deterioration, corrosion, contamination, failing components, weakened connectors, swollen batteries or prior damage. ComputerXpress is not responsible for damage caused solely by an existing defect, normal deterioration, manufacturer defect, previous repair or undisclosed condition.

5. Data and Backups

You are responsible for maintaining a complete backup before service. Diagnostics, repair, malware removal, system installation, storage testing, transfer and recovery can cause data loss or corruption. Unless we agree in writing to perform a backup, no backup is included. Preservation or recovery is not guaranteed, and authorized recovery charges may apply even if recovery is unsuccessful. This does not exclude liability that cannot legally be excluded.

6. Access and Remote Support

You authorize access to equipment, accounts, files, settings, networks and connected services only as reasonably necessary to diagnose, perform and test authorized work. During remote support, information visible on screen may be seen by the technician, and you may end the session at any time. Use temporary credentials when possible and change appropriate passwords after service.

7. Malware and Security

No service can guarantee a device will remain malware-free or completely secure. Malware can remain hidden, return or require system erasure. Security services and recommendations do not guarantee prevention of every infection, intrusion, breach or loss.

8. Parts and Software

Replacement parts may be new, used, refurbished, reconditioned, aftermarket or manufacturer-supplied as disclosed. Customer-supplied items are installed at the customer’s risk and are not warranted by ComputerXpress. Removed parts may be recycled, exchanged or retained for warranty processing unless return is requested in advance and allowed.

9. Warranties

Any warranty will be stated on the invoice, receipt or work order. Qualifying repairs may include a 30-day warranty on listed parts and labor for the original repaired issue. Coverage does not include unrelated problems, accidents, liquid damage, surges, misuse, later malware, work by others, customer-supplied parts, manufacturer defects or normal wear. These Terms do not eliminate rights that cannot lawfully be waived.

10. Returns and Payment

Returns are governed by terms disclosed at purchase. Completed labor, diagnostics, data services and software services are generally nonrefundable once performed. Special orders, activated licenses and custom-configured items may be nonreturnable. Payment is due when service is complete or equipment is ready unless otherwise agreed. Authorized diagnostics, labor, parts, taxes and disclosed third-party, travel or storage charges are payable.

11. Unclaimed Equipment

Customers must retrieve equipment promptly after notice. A reasonable storage fee may begin after 30 days only if disclosed in writing. Unclaimed equipment will be handled only after applicable notice and waiting requirements and only as permitted by Florida law. These Terms do not authorize disposal or ownership contrary to law.

12. Third-Party Services

Manufacturers, software publishers, payment processors, cloud providers, internet providers, shipping companies and specialized laboratories operate under their own terms. ComputerXpress is not responsible for their interruptions, defects, policy changes, licensing decisions or failures.

13. On-Site Service

Customers must provide safe access, needed utilities, an authorized adult and a hazard-free work area. We may stop unsafe, unlawful, threatening or out-of-scope work. Disclosed and authorized travel, parking, waiting or additional work charges may apply.

14. Website and Intellectual Property

Website information does not guarantee availability, price or results. Users may not gain unauthorized access, introduce harmful code, disrupt the site, commit fraud or violate law. Website content is owned by or licensed to ComputerXpress and may not be commercially copied without permission.

15. Warranty Disclaimer and Liability

To the fullest extent permitted by law, general website information is provided “as is.” Except for written warranties and rights that cannot be waived, we disclaim implied warranties. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive or consequential damages. Except where a limit is prohibited, total liability for a product or service will not exceed the amount paid for that product or service.

16. Events Outside Our Control

We are not responsible for delay caused by weather, disaster, outage, fire, theft, supplier shortage, government action, cyberattack or third-party failure. This does not excuse payment for services already provided.

17. Florida Law

These Terms are governed by Florida law. Subject to applicable consumer rights and court jurisdiction, proceedings shall be brought in a court of competent jurisdiction in Polk County, Florida.

18. Changes and General Terms

Updated Terms apply from the posted effective date and do not retroactively change previously authorized service unless agreed or required by law. If a provision is unenforceable, the remainder continues. Estimates, work orders, invoices, policies and separately signed agreements are incorporated as applicable. Electronic signatures, emails and text approvals may be used where permitted.
